1. Who we are

This website is operated by NICKOLAS GONCALVES ABAD LTDA, company tax ID (CNPJ) 57.498.154/0001-72, trading as NICBAD, at Est. Manoel Leôncio de Souza Brito, 2800, Vargem Pequena, Florianópolis/SC, 88052-400, Brazil.

By hiring our services or using this website, you agree to these Terms of Service.

2. Services provided

NICBAD provides professional digital marketing services, paid media management, e-commerce consulting and commercial content production, as described on the Services page.

The specific scope of each engagement is set out in a proposal approved by the client. Services not described in the proposal are not contracted.

3. Engagement

The engagement starts with written approval of the proposal and payment of the first monthly fee. The client confirms they are authorised to contract on behalf of the company they represent.

The client must provide the access, information and materials needed for execution. Delays in providing them may change delivery dates.

4. Prices and payment

Prices are those published on the Pricing page or agreed in a proposal, always in Brazilian Reais (BRL).

Billing is monthly and recurring on the anniversary date of the engagement. We accept credit card, Pix and bank slip. Card statements show the charge as NICBAD.

If payment is more than 10 days late, services may be suspended until settled. Annual adjustments follow the Brazilian IPCA index and are communicated 30 days in advance.

Ad spend paid to advertising platforms is not part of the service fee and is paid by the client directly to those suppliers.

5. Timelines and execution

Delivery times for each deliverable are stated in the proposal and on the Services page. Campaigns start within 5 business days of signature and access being granted.

6. Responsibilities and limits

NICBAD does not guarantee sales volume, revenue, return on investment or placement on third-party platforms. We work with targets and projections based on available data.

The client is responsible for the accuracy of its product information, for complying with the laws applicable to what it sells and for the advertising platforms' policies.

NICBAD's liability for any loss is limited to the amount paid by the client in the 3 months preceding the event.

7. Ownership and confidentiality

Materials produced and approved may be used by the client once the corresponding payment is made. Ad accounts, pixels, data and profiles remain the client's property.

Both parties keep commercial information exchanged during the engagement confidential.

8. Termination

Either party may end the agreement with 30 days' written notice. Fees for months already started follow the Refund and Cancellation Policy.

9. Governing law

These Terms are governed by Brazilian law. The courts of Florianópolis, Santa Catarina, have jurisdiction over any dispute.
